Court Date Continuance Request

Please follow these instructions for a continuance of your court date.

  • If your court date is nine business days or less from this date, you must fax your request to (757) 385-1063 or appear at our office in person, between the hours of 8 a.m. - 4 p.m., Monday - Friday, except holidays.
  • If your court date is 10 business days or more from today's date, please submit your continuance by mail.

Your written request must include:

  • Your full name
  • Current mailing address
  • Present court date
  • Arresting officer's name
  • Offense
  • Reason for your request

There is no guarantee that your case will be continued. It will be your responsibility to call back the afternoon of your court date or the following business day to find out if your case has been continued. You may also visit our web page, at www.courts.state.va.us to inquire about your continuance request.

Continuance requests are not accepted by telephone.

Public Defender Information

To determine if you qualify for a Public Defender, you should appear in the Traffic Division Office between the hours of 8 a.m. and 4 p.m. no later than 10 days before your court date. If the public defender has already been appointed and you need to contact their office, please call (757) 427-6050.

Appeal Information

In order to appeal a case, the defendant or their attorney must appear in person at the Traffic Division Office within 10 calendar days of the conviction. After 10 calendar days, the defendant has lost the right to appeal the case.

Research Requests

If you request a copy of the case paper before the court date or final disposition, the fee is $1 per charge for the first two charges and fifty cents ($.50) for each additional document thereafter.

Checks and money orders drawn from a Virginia financial institution are accepted. You also need to include a self-addressed stamped envelope with your request. Please include the following information:

  • Defendant's name and any known alias'
  • Date of birth
  • Social security number
  • Gender
  • Race
  • Specific charge you are requesting
  • Court date
  • Contact phone number or e-mail address of the requestor

Please allow a minimum of two weeks for research and mailing of requested documents.
